1. Overview
These Terms and Conditions govern your use of website hosting, WordPress hosting, email hosting, migration assistance, support, and related services provided by Clever Studios, LLC dba SFXHosting.com ("SFXHosting", "we", "us", or "our"). By ordering, renewing, using, or accessing our services, you agree to these terms.
SFXHosting provides hosting services to customers in the United States and may use upstream infrastructure, software, control panel, data center, domain, email, CDN, security, and service providers, including 20i Ltd where applicable. Those upstream services help us deliver hosting features, but your customer relationship is with Clever Studios, LLC dba SFXHosting.com unless a third-party checkout or provider states otherwise.
If you are accepting these terms for a company, organization, client, or other legal entity, you confirm that you are authorized to bind that party.
2. Account registration and security
You agree to provide accurate, current, and complete account, billing, domain, and contact information. You are responsible for keeping passwords, control panel access, email accounts, SSH credentials, API keys, and other authentication details secure.
You must notify us promptly at support@sfxhosting.com if you believe your account, website, mailbox, or credentials have been compromised. We may suspend access if we reasonably believe an account is inaccurate, fraudulent, compromised, abusive, or creating risk for other customers or the platform.
3. Hosting services
Our services may include Linux website hosting, WordPress hosting, email hosting, SSL, CDN, WAF, DDoS protection, malware scanning, website migrations, backups, databases, DNS tools, control panel tools, and related features described on our website or in your order.
Features described as "unlimited" are intended for normal website and business use. Unlimited resources may not be used for bulk file storage, backup archives unrelated to hosted websites, media libraries unrelated to websites, torrent or proxy services, cryptocurrency mining, mass mailing, abusive automation, or activity that harms performance, security, reputation, or availability for other customers.
We may apply fair-use controls, suspend abusive activity, require upgrades, or ask you to reduce usage if your account creates platform risk, excessive resource consumption, security issues, or deliverability problems.
Website Turbo, CDN, cache, optimization, WAF, DDoS protection, malware scanning, SSL, backup, and related tools are provided as commercially reasonable hosting features. They reduce risk and improve performance, but they do not guarantee that every page will load instantly, every attack will be blocked, every vulnerability will be detected, or every data loss event will be recoverable.
4. Orders and service activation
Your order is an offer to purchase services. We may accept, reject, review, or cancel orders for fraud prevention, payment issues, incorrect pricing, compliance concerns, technical limitations, or other reasonable business reasons.
Services are considered active when access is provisioned, credentials are issued, a control panel is made available, a migration begins, or a confirmation email is sent. You are responsible for checking order details before purchase, including plan limits, yearly billing, domains, renewal pricing, and add-ons.
5. Pricing, billing, renewals, and refunds
Prices on SFXHosting.com may be shown as monthly equivalents for comparison, but hosting plans may be charged annually at checkout. Your checkout page, invoice, receipt, or order summary controls the actual amount billed.
Unless stated otherwise, hosting renews for the same billing term at the then-current renewal rate. You are responsible for canceling services before renewal if you do not want them to renew. We may change pricing with reasonable notice where required by law or commercially practical.
SFXHosting offers a 30-day money-back guarantee for eligible hosting plans, limited to one refund per customer or household unless we approve otherwise. Domain names, domain renewals, premium SSL certificates, paid third-party licenses, migration labor already performed, dedicated or special-order services, and add-ons may be non-refundable.
If a payment fails, is reversed, disputed, or charged back, we may suspend or terminate services, remove promotional pricing, recover fees, or require an alternate payment method.
6. Cancellation, suspension, and termination
You may request cancellation by contacting support. For account safety, we may ask you to confirm cancellation before deleting hosting, email, databases, DNS, or files. Your cancellation is not complete until confirmed by us or processed in the applicable customer area.
We may suspend or terminate services if you violate these terms, fail to pay, create security or abuse concerns, use excessive resources, submit fraudulent information, violate law, harm service reputation, or interfere with other customers or upstream providers.
After cancellation, expiration, termination, or non-payment, data may be deleted. You are responsible for exporting and preserving any files, email, databases, DNS records, backups, or logs you need before cancellation or expiration.
7. Acceptable use
You may not use our services for illegal activity, malware, phishing, credential theft, spam, unsolicited bulk email, network attacks, botnets, hate or harassment campaigns, child exploitation, intellectual property infringement, fraud, impersonation, privacy violations, or content that creates legal or operational risk for SFXHosting or our providers.
You are responsible for all content, code, scripts, plugins, themes, applications, users, email activity, DNS records, and data placed on or sent through your account. You must keep websites, CMS installations, plugins, themes, passwords, and scripts updated and secure.
Email services may not be used for spam, purchased lists, scraped lists, deceptive mail, malicious attachments, high-bounce campaigns, or sending that harms IP/domain reputation. We may limit, suspend, or block email activity that creates deliverability or abuse risk.
8. Domains, DNS, SSL, and IP addresses
If we assist with domains, DNS, SSL, or nameservers, you remain responsible for confirming that records, renewals, nameservers, registrant details, email routing, and website routing are correct. Domain registration and renewal may be subject to registrar and registry rules outside our control.
IP addresses, nameservers, CDN endpoints, SSL automation, routing, and platform identifiers are provided as part of the service and are not sold or transferred to you. They may change for maintenance, security, routing, provider, or operational reasons.
9. Support and migrations
We provide support for hosting access, account questions, DNS guidance, email setup, migrations, SSL, control panel features, and platform issues. We may provide WordPress and website guidance, but we are not responsible for custom development, third-party plugin conflicts, broken code, SEO rankings, business losses, or application-level bugs unless expressly agreed in writing.
Free migrations are performed on a commercially reasonable basis and may depend on access to your old host, file size, database size, DNS control, account condition, third-party restrictions, and site complexity. You should keep your prior hosting active until migration and DNS propagation are complete.
10. Customer data, backups, and security
You own your website content and customer data. You grant us and our providers permission to host, store, transmit, cache, scan, back up, restore, and process that data as necessary to provide the services.
Backups and restore tools are offered for convenience and disaster recovery, but you remain responsible for maintaining independent backups of important files, databases, email, DNS, and business records. No backup system is guaranteed to be complete, current, or available in every scenario.
You are responsible for complying with privacy, data protection, ecommerce, accessibility, consumer protection, tax, industry, and other laws that apply to your websites, users, customers, and content.
11. Disclaimers and limitation of liability
Services are provided on a commercially reasonable basis. We do not promise uninterrupted service, error-free operation, perfect security, guaranteed search rankings, guaranteed deliverability, guaranteed uptime, or guaranteed revenue results.
To the maximum extent allowed by law, SFXHosting and Clever Studios, LLC will not be liable for indirect, incidental, special, punitive, consequential, or business-loss damages, including lost profits, lost revenue, lost rankings, lost data, lost goodwill, or interruption of business. Our total liability for a claim will not exceed the amount you paid us for the affected service during the three months before the event giving rise to the claim.
12. Changes to these terms
We may update these terms from time to time to reflect service, legal, security, billing, provider, or business changes. The updated terms will be posted on this page with a revised date. Continued use of the services after changes are posted means you accept the updated terms.
